A rental key handover deserves more than a conversation at the door. Recording who gives and receives the keys, when it happens and the property’s condition helps both landlord and tenant organise the end of a tenancy. This guide provides a practical checklist. It is not a settlement template and does not decide the amounts due in an individual case.

Bring the agreement and original inventory
Gather the tenancy agreement, attachments, initial inventory and any photographs from the start of the tenancy. Add relevant messages about repairs or problems. This gives you a concrete reference for comparing the final condition rather than relying entirely on memory.
Article 1561 of the Spanish Civil Code addresses returning the property at the end of the lease, with an exception for deterioration caused by time or unavoidable causes. That rule does not turn every mark into compensable damage or settle a disagreement about its origin. An assessment needs the facts and evidence.
Rental key handover: list what changes hands
Identify the property, date and people taking part. If someone other than the landlord receives the keys, clarify their role. Count entrance, building, mailbox and garage keys separately, together with any remote controls or access cards.
A specific list makes a missing item easier to identify. For example, «two sets of keys and one garage remote» gives more information than a general reference to all the keys. Keep a copy of the document and attachments in the version accepted by both parties.
Check the property room by room
Review floors, walls, doors, windows and the furniture or appliances included in the inventory. Describe each issue precisely: the room, item and observation. Avoid broad wording such as «everything is perfect» if some points have not been checked.
General photographs show the room; close photographs show the item in question. Keep the original files and an index identifying them. Also record the points agreed and those still unresolved, without treating a single photograph as an automatic decision about responsibility.
Record meter readings and utility information
Where relevant, note water and electricity readings, the date and the meter concerned. A clear photograph can accompany the record. Then identify which bills have been issued and which may arrive later for earlier periods.
A reading does not replace the steps required by a utility provider. Confirm who will arrange the relevant changes or notifications according to the agreement and actual circumstances. Handing over keys does not automatically cancel a supply or resolve its billing.
Separate the keys from the financial settlement
List outstanding rent, utilities, disputed expenses and the security deposit separately. If someone proposes a deduction, ask for the item, amount and supporting documents. Keep an open estimate distinct from an amount that both sides have already accepted.
Article 36.4 of Spain’s Urban Leases Act provides for legal interest on the deposit balance due for return if it remains unpaid a month after the keys are handed over. This concerns the balance actually owed. It does not itself decide which deductions are justified or make every claimed amount an acknowledged debt.
Keep a clear rental key handover file
- The accepted handover document and attachments.
- The initial inventory and final inspection record.
- Original, identifiable photographs.
- Meter readings and relevant bills.
- Payment receipts and correspondence about outstanding amounts.
If a document includes a final settlement, waivers or commitments you do not understand, ask a lawyer to explain them before accepting. The effect of the closure depends on the document and circumstances. This checklist does not replace that review.
Contact and coordination through Renova
Renova can help you contact legal professionals and organise documents. The lawyer who accepts the engagement assesses damage, amounts and possible action. For questions about appointing a professional, read our lawyer engagement letter guide.
When you contact us, briefly describe the situation and handover date. Mention any document awaiting signature or notice with an approaching date. An initial enquiry does not create a professional engagement or suspend a deadline.
